Sebastian GhitaPatronul Romania TV, Sebastian Ghita (pozitia 90 in tabelul de mai jos), deputat din partea PSD in Parlamentul Romaniei, se afla pe lista celor care au votat favorabil, marti, in Camera Deputatilor, proiectul de modificare a Codului Penal care confera super-imunitate politicienilor si care ataca institutiile anti-coruptie ANI si DNA. Mai mult, printre modificarile care au scandalizat opinia publica figureaza si reincriminarea penala a insultei si a calomniei, adica o lovitura data inclusiv angajatilor sai de presa de la Romania TV.

De asemenea, toti oamenii din Partidul Conservator ai lui Dan Voiculescu, patronul de facto al trustului media Intact, cu o singura exceptie, au votat si ei pentru adoptarea legilor care ii scutesc pe alesi de raspundere penala si pun in pericol statul de drept.
Bogdan Ciuca, seful Comisiei juridice din Camera, cel care in noaptea de luni spre marti a facut parte din “comando”-ul care a pus la punct legile trecute a doua zi dimineata pe ordinea de zi, este cunoscut ca un apropiat al familiei Voiculescu. El nu a votat insa in plen, asa cum a facut-o in schimb juna Catalina Stefanescu (pozitia 213 in “lista rusinii”), celebra secretara de la Teleorman a lui Liviu Dragnea, facuta parlamentar peste noapte.
La discutiile din miezul noptii, alaturi de Ciuca, de Valeriu Zgonea si de altii, a fost prezent si Sebastian Ghita (foto). Potrivit surselor noastre, patronul RTV a fost unul dintre creierele operatiunii. El, Zgonea si Ciuca s-ar fi implicat direct in trecerea pe ordinea de zi a sedintei de marti a legilor amintite, inclusiv prin plasarea pe lista unui proiect de tip “fumigena” (amnistia si gratierea), menit sa distraga atentia de la adevarata tinta a operatiunii – modificarea Codului Penal pentru protejarea politicienilor penali.
Premierul Victor Ponta declara in aceasta dupa-amiaza ca el nu stie nimic despre ce s-a petrecut luni noapte si marti in Camera Deputatilor. Avand in vedere prietenia sa cu Sebastian Ghita, greu de crezut ca Ponta n-a stiut nimic despre asaltul pregatit luni noapte impotriva presei si a statului de drept. De mentionat, ca atat Ghita, cat si Ciuca, dar si alti deputati care au votat pentru adoptarea legilor anti-Justitie sunt oameni cu dosare penale.

    Romania: The Putsch against the Rule of Law Continues

    Dear President of the European Commission,
    Dear Commissioners,
    Dear Secretary General,

    This is to inform you that the putsch against the rule of law in Romania, started in the summer of 2012, continues in full force. On Tuesday, December 10, the Parliament has given a full waiver of criminal liability to MPs involved in corruption and decriminalized conflict of interest. Through these amendments, full impunity for powerful politicians returns to Romania, bringing us back to the early 90s, invalidating the work of DNA, ANI and brave judges.

    1. MPs are no longer covered by the Criminal Code in respect to corruption and abuse in office. This undermines the Constitutional principle of equality before the law. The immediate effect of this provision would be that all on-going investigations will stop, all pending trials will end, and all convicted MPs will be freed. According to the DNA, 28 MPs are in the latter two situations.
    2. Conflict of interest has been decriminalized: mayors, MPs, ministers, and public servants are no longer covered by the conflict of interest and administrative acts such as public procurement contracts are also exempted from the legal coverage of this crime. Thus, enormous public resources are left unprotected in a country where conflict of interest is rampant. According to the Integrity Agency (ANI), the entering in force of this provision will invalidate investigations against 25 MPs and 79 locally elected officials found to be in conflict of interest (this excluding dozens of civil servants).

    In other words, by and large, a tenth of the MPs will be direct beneficiaries of the provisions they voted in favor of yesterday.

    Please note that a general amnesty and pardon law, covering the vast majority of crimes, postponed in yesterday’s session, has just been placed on next week’s Parliament agenda. This law would have a huge impact on Romania’s Schengen accession.

    Just like in the summer of 2012, everything happens overnight, in a rush, with no consultations, in total lack of transparency and full disrespect for the citizens, and without even asking the opinion of the judicial institutions involved.

    As the Romanian democratically elected institutions fail to represent us, we, as European citizens, turn to you to protect our rights, guaranteed by the Treaty.

    1. We ask you to urgently establish an exceptional mechanism to reassess Romania’s compliance with the Copenhagen criteria, as well as with all the other commitments as a EU member state, and enforce credible penalties in case of default. Among options are suspending the voting rights in the Council and/or access to European funds.

    2. We call upon you to set up a new mechanism, on top of the CVM, to ensure that the rule of law remains the cornerstone of the European establishment in each and every of its members. Romania proves these months that the compliance with the Copenhagen criteria is not irreversible after accession.

  4. Este jalnic sa vad ca dl Aurel Vainer reprezentand minoritatea evreiasca a votat si el pentru aceasta ticalosie cu codul penal. Ma consolez ca fiind in varsta nu prea a stiut ce voteaza. Dar totusi..sa vedem ce face data viitoare?

    Eu as dori sa aflu CINE ESTE CU ADEVARAT IN SPATELE LUI GHITA (in afara de securisti), pentru ca, vazandu-i (nu o singura data) privirea ca de “curca-n lemne”, imi este foarte greu de presupus ca pe ghita il duce mintea la ceva de o asemenea anvergura !
